🌿 Biogas and Biomethane: Other Environmental Permits - Permit for Discharging Gases or Particulates into the Air 🌿


Obtaining a permit for discharging gases or particulates into the air is required only for biogas plants with a nominal thermal power exceeding 15 MW. Therefore, it is necessary only for a narrow group of the largest biogas plants, which, due to their technical parameters, will most often qualify for an integrated permit. The practical application of this permit for biogas plants is therefore minimal. 🌬️




📜 The Authority Responsible for Issuing the Decision:


County Governor:


  • In most cases.


Provincial Marshal:


  • In the case of installations classified as projects that can always significantly impact the environment.


⏳ Duration of Proceedings:

  • Standard Time: 1 month

  • Especially Complicated Cases: 2 months from the initiation of proceedings.

In practice, this period may be longer, as it does not include the timeframes provided for obtaining agreements, opinions, or periods of suspension of proceedings. Additionally, the issuance of the decision may be delayed for other reasons, such as the fault of the party or reasons beyond the control of the authority, such as the need to supplement documentation. 📅


🕒 Permit Validity Period:

The permit is issued for a specified period, not exceeding 10 years. 🗓️


💰 Fees for Issuing Decisions:

  • 2011 PLN for large enterprises.

  • 506 PLN for micro, small, or medium enterprises.

  • Notary fee for power of attorney: 17 PLN.


📨 How Can I Appeal?

  • Appeals against decisions issued by the provincial marshal must be filed within 2 weeks of receiving the decision with the Minister of Climate and Environment.

  • Appeals against decisions issued by the county governor must be filed within 2 weeks of receiving the decision with the appropriate Local Appeals Board.

  • Further appeal options include lodging a complaint with the Provincial Administrative Court and subsequently with the Supreme Administrative Court. ⚖️
